Welcome to AdwayCreative. These Terms and Conditions govern the relationship between NAVKAT Ltd., operating under the AdwayCreative brand, and clients or website users who access our website or use our services.

1. Scope of services

AdwayCreative is a digital agency providing services such as digital marketing strategy, Google Ads and Meta Ads management, SEO, website development, video production, branding, creative services and consulting. The exact scope, deliverables, timeline and pricing of each service are agreed individually through an offer, written confirmation or contract.

2. Rights and obligations

• Agency obligations: we commit to delivering agreed services professionally, within agreed timelines and in line with industry best practices.
• Client obligations: the client agrees to provide required materials, access to accounts, approvals, feedback and information needed for project delivery. Delays in providing these items may extend project timelines.

3. Payment terms

Prices are based on the specific project scope or service agreement. Payments are made by bank transfer based on an invoice issued by NAVKAT Ltd. Subscription services such as advertising management, SEO or ongoing support are invoiced regularly according to the agreed terms.

Note: Advertising budgets paid to platforms such as Google, Meta or other media providers are normally paid directly by the client to the respective platform, unless agreed otherwise in writing.

4. Intellectual property

Materials, strategies, creative assets, code and deliverables created by AdwayCreative remain the intellectual property of the agency until full payment is received. After full payment, rights to final deliverables such as websites, final creatives or approved materials are transferred to the client, unless third-party software, licensed assets or subscription tools are involved.

5. Limitation of liability

AdwayCreative works in the client’s interest, but cannot guarantee a specific number of sales, leads, rankings, revenue or financial results because outcomes depend on market conditions, offer quality, competition, website performance, sales process and platform policies. We are not responsible for account suspensions, policy changes or algorithm changes made by platforms such as Google, Meta or other third parties.

6. Applicable law

These Terms and Conditions are governed by Bulgarian law. Any disputes should first be resolved through good-faith negotiation. If no agreement is reached, disputes may be referred to the competent Bulgarian court.
